Filing Domestic Violence & Gun Violence Restraining Orders

Overview

Marin County Superior Court accepts electronically filed Domestic Violence and Gun Violence Restraining Orders, pursuant to SB 538.

Filings can be submitted through ePortal free of charge, or eFiling. Note: Any filings submitted through eFiling may incur a charge from the EFSP (Electronic Filing Service Provider).

Submission through ePortal

To electronically file Domestic Violence & Gun Violence restraining orders through ePortal, the user must register an account.  If you have an existing Family Law case, you will need to request Party Access before submitting the Domestic Violence filing.  Below are instructions on how to register, and how to submit the restraining orders electronically.  For more information on ePortal, please click here.

Before you can submit a Restraining Order filing, you are required to register an ePortal account. 

  1. Click here to begin registration
  2. Fill out User Information:
    • Enter your email address
    • Enter Personal Information: First Name, Last Name, Phone Number
  3. Agree to the Terms of Use
  4. Click “Create New Account”
  5. Check your email and click the one-time login link that expires after 24 hours. If it expires, you can use the “Request new password” feature on the home page.

Note: If it is not in your inbox please check your “Spam” or “Junk” inboxes.

  1. ePortal will prompt you to change your password.
    1. The password must contain:
      • At least 6 characters
      • At least one lowercase letter and one UPPERCASE letter
      • At least one number
      • At least one special character (punctuation)
  2. Click Save after entering your new password twice.  You should see a green message “The changes have been saved.”  You have successfully created an account.

Now that you’ve registered, you may submit Domestic Violence and Gun Violence filings.

Note: If you have an existing Family Law case (non-DCSS), or an open Domestic Violence case, follow the “How to submit a new Domestic Violence filing Within an Existing Case” instructions.

  1. Complete the required Judicial Council forms in PDF format:
  2. Log in to ePortal
  3. On the left, under “Filings,” click “Domestic Violence Filing”
  4. Fill in the “Domestic Violence Filing” page.  Note: Any areas with a red asterisk are required.
  5. Upload your PDF documents
    • Click “Choose File” and a new window will appear
    • Select the file
    • Repeat steps above for the remaining documents
  6. Click Proceed

If the submission is successfully sent to the Court, you will see the message: “Your submission has been sent through ePortal Submission for filing purposes;” otherwise you will see an error message indicating what required information is missing.

  1. Request party access for the existing case.  Use this form to do so. The Court must verify your information before providing party access.
  2. After party access has been provided, log in to ePortal.
  3. Click “My Cases”
  4. Click “View Case”
  5. Scroll down the page and click “Add Domestic Violence Filing”
  6. Fill in the “Add Domestic Violence Filing” page.  Note: Any areas with a red asterisk are required.
  7. Upload your PDF documents
    • Click “Choose File” and a new window will appear
    • Select the file
    • Repeat steps above for the remaining documents
  8. Click Proceed

If the submission is successfully sent to the Court, you will see the message: “Your submission has been sent through ePortal Submission for filing purposes;” otherwise you will see an error message indicating what required information is missing.

Submission through eFiling

You may submit Domestic Violence & Gun Violence filings through eFiling.  Please note that eFiling is mandatory for all parties represented by attorneys.  Self-represented parties may use eFiling but are not required to pursuant CRC 2.253(b)(2) and CCP1010.6(f)(2).

Frequently Asked Questions

  1. Log in to ePortal
  2. Click “Case Search”
  3. Enter the case number
  4. Click Search.  The Status column will indicate if the case is Open or Closed.

For new filings: If Yes is selected, you are agreeing that the Court may send documents electronically.  If No is selected, you are agreeing that the Court may send documents by mail.

For new filings within an existing case (Domestic Violence Only): If email address is entered, you are agreeing that the Court may send documents electronically.  If no email address is entered, you are agreeing that the Court may send documents by mail.

The address of the person you want protection from is not required.

You may have selected a non-PDF file.  Click “Choose File” and select a PDF file.

  1. Log in to ePortal
  2. Click “My Cases” and look at the Status Column.  If the status says:
    • “EFILED” your case has been sent to the Court and is pending acceptance.
    • “OPEN” your case has been accepted by the Court. Note: This does not indicate that your Restraining Order is granted or denied.
    • “REJ” your case has been rejected by the Court.
    • “CLOS” your case has been closed by the Court.

  • “Add Domestic Violence Filing” is used to file a new Restraining Order within an existing case.
  • “Add Domestic Violence Documents to Existing Case” is used to file additional Restraining Order documents.

The existing case does not contain a Domestic Violence filing.
